The photos (also referred to
as "images") on this website
(uncommondays.com and uncommonphotos.com)
are owned by UnCommonDays.com,
LLC and may be used only within
the terms of this agreement. The photos may be licensed
for Royalty-Free use only
through this online store. Right of
usage for images purchased under
Royalty-Free terms is non-exclusive
and non-transferable. Images
may not be rented, loaned, sold,
given to another party,
made available for download or
distributed either alone or
in a collection. Usage is granted
only to the individual or company
purchasing such usage rights
as determined by the owner of
the credit card used to make
the purchase. This individual
or company is referred to as
the "licensee".
Royalty-Free
Use & Restrictions:
Photos licensed under Royalty-Free
terms are intended for commercial
and professional design use.
The photos may be used for any
design project including advertisements,
brochures, websites and other printed
materials and electronic media. Photos may
be used multiple times for multiple
projects by the licensee. Photos
may
be
altered except where alterations would cause the final product to be
defamatory, offensive, pornographic
or to violate any law. Pornographic,
defamatory, libelous or otherwise
unlawful use of any photo or
image is strictly prohibited.
Limit of Liability
Neither UnCommonDays.com, LLC nor
it’s licensers, managers, employees,
officers, agents or contributors shall be liable to licensee for
any consequential, incidental,
direct, indirect damages or
any other damages arising from
licensee's use of photos/images
whatsoever. This includes any claims
by third-parties from which licensee
shall hold UnCommonDays.com,
LLC harmless from such
actions. Images which include
people or trademarks, whether
recognizable or not are provided
on a non-model release basis.
It is the sole responsibility
of the licensee to avoid using
such images in a way that defames,
insults, suggests endorsement
or violates law.
Guarantee
UnCommonDays.com, LLC guarantees
complete satisfaction.
For any reason, licensee may request
a full refund within seven (7) days
of purchase. Licensee must provide
signed, written statement of the
reason a refund is requested and
written assurance that licensee has
not used the image in any project,
has discontinued use of the image
in any pending project and has destroyed
the image file for which a refund
is requested. A refund
will be issued to the purchaser's
credit card.
This agreement shall be governed
by the laws of the State of
New Hampshire.
